The Copyright Act, 1957, along by the Copyright Rules, 1958, is the governing law for copyright protection in India. The Copyright Registration India provides that a copyright subsists in an original literary, dramatic, musical or artistic work, cinematographic films, and sound recordings, whereas few things such as methods and procedures for mathematical operations cannot be copyrighted. With copyright registration it gives the original owner the peace of mind against the work he created or rewarded.
The Copyright Registration Online is usually valid for lifetime of the author and 60 years after the passing of the author the work would be under his name. Copyright Registration India protects the work from being copied with certain exemptions provided under the act. The work once granted copyright registration is granted protection for the prescribed time period and whosoever copies the work without permission of the owner amounts to copyright infringement.
PROMOTION – Copyright Registration India promotes your unique piece of work, as you hold the rights for it, hence it acts as the best form of promoting your work.
INFRINGEMENT PROTECTION – It provides the author with a legal way to get to people who are stealing their work and making a living out of the efforts of the hard produced things.
EVIDENCE – These serve as prima facie evidence with reference to dispute relating to ownership of copyright. Certificate of registration is considered “admissible evidence” in the court of law.
PROTECTION – Copyright protection ensures that the work we have legally registered would remain unique and none can claim rights over it.
NATURE OF WORK –The nature of work can be well-defined with all the references hence that would make the procedure a bit easier and would also aid in better legal protection in terms of infringement.
PERFORMER RIGHTS – The performer rights are for the people who are directly responsible for the creation of work other than the studio or place or a firm that has involved in the production.
Copyright serves as a protective shield for a diverse range of creative outputs. The Registrar of Copyrights has structured a detailed register, segmented into six clear categories, each dedicated to particular types of intellectual creations:
Literary Works (Excluding Computer Programs): This division includes various written works like novels, poems, essays, articles, and similar creations.
Musical Works: Items like tunes, song lyrics, and musical notations fall within this category.
Artistic Works: Copyright in this realm covers visual arts like paintings, sculptures, drawings, and similar artistic endeavors.
Cinematography Films: Films and related audiovisual projects enjoy the benefits of copyright protection in this category.
Sound Recordings: Audio recordings, whether they are of music, spoken word, or other sound-driven content, are protected here.
Computer Programs, Tables, and Compilations: The digital world’s cornerstones, such as software, data tables, and compilations, receive their protection in this segment.
Copyright is a right given by the law to creators of literary, dramatic, musical and artistic works and producers of cinematographic films and sound recordings. In fact, it is a bundle of rights including, inter alia, rights of reproduction, communication to the public, adaptation and translation of the work. There could be slight variations in the composition of the rights depending on the work.
Copyright protection is done to keep the work produced unique and provide a way to file infringement in case of anyone trying to steal the work of art.
Literary works (e.g., written books, computer programs, website) Dramatic works (e.g., scripts for films and dramas) Musical works (e.g., melodies) Artistic works (e.g., paintings, photographs).
